Terms and conditions
The following Terms and Conditions constitute an agreement between the Entrants, the Promoter and Trinity Mirror plc, One Canada Square, Canary Wharf, London E14 5AP.
It is important that Entrants read the Terms and Conditions carefully and understand what they mean. By making entering into the Game, Entrants confirm their complete understanding and acceptance of these Terms and Conditions.

- The Game will run in the Newspapers or any such Trinity Mirror plc national or regional titles as may be deemed appropriate from time to time and on the Websites and/or in other partner publications and on other websites as deemed appropriate from time to time.
- Entrants must be aged 18 years or over at the time of registration. Failure to observe this will deem any winning entry invalid and prizes will be forfeited.
- Employees of Trinity Mirror plc, cleverTV Ltd, Jennings Bet, their respective group companies, agents, and members of their families or households are not allowed to enter.
- Trinity Mirror Standard Competition Rules apply. Where any conflict exists between Trinity Mirror Standard Competition Rules and the Game Terms and Conditions contained herein, the Game Terms and Conditions shall prevail.
- All game instructions form part of the terms and conditions.
- Entry to the Game will be accepted from Wednesday, 28 March, 2007 until Midnight GMT on Wednesday, 8 August, 2007. Scoring for the Game will commence on Thursday, 5 April and conclude on Sunday, 12 August, 2007
- To score points from the start of the competition internet entries must be received no later than 12.45pm GMT on Thursday, 5 April, 2007. Postal entries must be recieved by Thursday, 5 April, 2007. Postal entries received after Thursday, 5 April, 2007 cannot be guaranteed to be processed.
- Acceptable methods of entry into the Game:
- Online via the Websites. Payment to be made by the Entrant using a valid credit/debit card. Cost per team £5. Entrants entering online will also incur their own cost (if any) of time spent accessing the internet.
- Post via the official Game coupon published in the Newspapers. Payment to be made by the Entrant by enclosing cheque or Postal Order for the required amount.
- The Promoter may from time to time offer Website and Coupon Entrants discounts and special promotions at its sole discretion. To qualify for discounts and special promotions Entrants must comply with the offer conditions.
- There is no limit to the number of teams that can be entered per Entrant (subject to these Terms and Conditions). However each team entry must be different and have a different team name (except on multiple entry Coupons where more than one entry has been made; in these cases the team name will be applied to each of the team on the form with the suffix 1, 2, 3, 4 or 5). The Promoter reserves the right to reject duplicate teams from the same entrant.
- The Promoter reserves the right to reject any team name that it considers to be inappropriate or offensive. In such an event, the Promoter will automatically apply another team name. Inaudible, unintelligible, incomplete or incorrect entries will be regarded as invalid. The Game computer's record of an entry will be regarded as the entry itself. The Promoter and Trinity Mirror plc will not be held responsible for entries lost or distorted in transfer. Proof of magnetic transcript is not accepted as proof of entry.
- Each team entered into the Game must contain 8 golfers; consisting of the specified number from each section, ie: two Champions, two Contenders, two Hopefuls & two Longshots. Golfers cannot appear in the same team more than once. Only the official Golf Genius 2007 player listing and categories apply. The Promoter will not enter into any correspondence in this regard.
- A unique 12-digit PIN number will be supplied for each internet and postal team correctly entered into the Game. It is the Entrant's responsibility to ensure retention of their PIN(s) which may be required for login and security. Website entrants will receive their PIN(s) via a confirmation email delivered to the email address supplied during registration. Postal entrants will receive a team confirmation letter (can take up to 21 days) with their team line-up, PIN and details on how to make transfers. In the event entrants lose their PIN(s) a telephone helpline will be in operation on weekdays between 10am and 5pm on: 0870 487 0183 (ROI: 0044 870 487 0183). Calls will be charged at BT's National Rate from UK BT landlines.
- The Promoter will provide up-to-date golfer statistics throughout the Game, where possible to be published weekly on the Websites and in the newspapers.
- Only points scored during USPGA Tour and European Tour events played between (and Including) The Masters and the USPGA and awarded in accordance with the How to Score rules detailed from time to time on the Websites and in the Newspapers will apply. Check the Calendar section of the websites for full details. Points are scored as follows: Tournament finishing position - 1st 50 points; 2nd 40; 3rd 30, 4th 25; 5th 20; 6th 18; 7th 16; 8th 14; 9th 12; 10th 11; 11th 10; 12th 9; 13th 8; 14th 7; 15th 6; 16th 5; 17th 4; 18th 3; 19th 2; 20th 1pt. Best round (x4) - 10pts. The player(s) who shoots the best round on each of the four tournament days. Makes cut - 4pts. Any player who makes the half-way cut. Majors - there are double points for the Masters, US Open, British Open and USPGA.
- A maximum of 20 transfers per team are permitted. No transfers are permitted prior to May 8th. Transfers will work on a weekly basis with a cut-off/team freeze at midnight on Wednesdays. See the How To Play section on the websites for more details. The points contribution of a player transfered out of an Entrant's team will be frozen. Points accrued by new players prior to being transfered into an Entrant's team will not be added to the Entrant's overall team score.
- There will be a Transfer Amnesty prior to the start of the competition. If you enter online you get 100 free transfers for use prior to the competition starting at 12.45pm on Thursday, April 5 2007. If one of your selected players gets injured or you decide you'd prefer another player in your line-up you will be able to carry out that transfer provided it's made prior to the tournament starting. NB. This will not affect your allowance of 20 transfers for use during the competition. There will be no extra cost if you make the transfer (s) online. If you make transfer (s) via the phone the normal costs will apply.
- Coupon / postal entrants can make transfers via the website or telephone. Check your team confirmation letter for details.
- The winner of the Game will be the entrant whose team has scored the most number of points throughout the Game. None of the prizes will be shared. In the event of a tie on points for any of the places for which there is a prize, the highest number of tournament winners in a team will be taken into account with the team with the highest number of tournament winners being awarded the higher prize. In the event of a further tie, then the highest number of tournament seconds will be considered in the same way, then thirds, then fourths, and so on down to 20th. In the unlikely event of a further tie, the Promoter will consider the number of Best Rounds per team and then the number of Made Cuts per team. If teams are still tied at this stage then the team whose entry was received first (according to the date and time of receipt recorded by the Promoter) will be awarded the higher prize. The Promoter's decision is final and neither it nor Trinity Mirror plc nor any of its affiliate partners will enter into negotiations or any ensuing correspondence that may be associated with an appeal to the decision.
- Prizes will be awarded only in accordance with the Prize Fund detailed from time to time on the Websites and in the Newspapers. Overall Game: Winner - £10,000, Runner-up - 7-day holiday for 2 to USA*, 3rd - £1,500 plus Nike Sasquatch Sumo driver, 4th prize - £750 plus Callaway waterproofs, 5th prize - £500 plus Odyssey putter, 6th prize - £250 plus Adidas Tour 360 golf shoes. PLUS £1,000 for top team in each of 4 Majors; 2nd - Nike Sasquatch Sumo driver; 3rd - Callaway waterproofs; 4th - Odyssey putter; 5th - Adidas Tour 360 golf shoes; 6th - 12 x Nike Platinum Mk III balls.
* Holiday detail: 7 day holiday for 2 to Hilton Head, USA. Staying in 5 star Marriott hotel, prize inclusive of accommodation, flights and 4 rounds of golf (subject to availability). No cash alternative. Travel originates from the UK and the winner must arrange their own transport to and from the point of departure. The winner and their accompanying party must have valid passports and carry all necessary documents (including visas, if necessary). We suggest that winners arrange suitable travel insurance to cover the trip. All hotel accommodation is subject to availability in the hotel at the time of booking. Winners may be required to give alternative dates and sufficient advance warning of their proposed dates of travel. The holiday must be taken by 31/08/08.
- Winners will be notified via email or telephone. All winners are required to co-operate with the Newspapers photographers or reporters to publicise their win as Trinity Mirror plc and/or the Promoter deems appropriate. Failure to comply with this rule may result in disqualification of the entry.
- For the avoidance of doubt all entries from all Newspaper titles will compete in one Game. There is one prize fund across all Newspaper titles and therefore there are no prizes exclusive to readers of a particular Newspaper title.
- The Promoter and Trinity Mirror plc have made all reasonable endeavours to ensure that the Game is provided using reasonable skill and care. However, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the Game itself nor in relation to disruptions, delays or errors in connection with the Websites or the internet, in particular for any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the Websites, all to which without limitation The Promoter and Trinity Mirror plc accepts shall not be held responsibile. Further, no warranty is made in respect of information to which you may have access but which has not been directly provided by the Promoter and/or Trinity Mirror plc, including without limitation, information on the internet available outside of the Websites which shall remain the responsibility of the provider of such information.
- Except as expressly provided in these Terms, and to the extent permitted by law, Trinity Mirror plc, its employees, agents and partners disclaim any and all liability in respect of any loss or damage arising out of the Game, Newspapers and/or Websites, whether such loss or damage results from negligence, breach of statutory duty or otherwise, and whether in contract or in tort or otherwise, including but not limited to the loss or corruption of data, any errors or omissions, content, delays or interruptions in transmission or operation and lines or communication failure. In no event shall the Promoter and Trinity Mirror plc be liable for any loss of profit, goodwill and any indirect, special or other consequential or incidental damage, whether foreseeable or not.
- In the event that any liability does arise then the liability of Trinity Mirror plc and/or the Promoter whether in contract, tort or at law shall be limited in aggregate to the money paid by the relevant Entrant in lieu of registration to play the Game.
- Without limitation all of the Game Materials in the Newspapers and on the Websites is the exclusive property of Trinity Mirror plc and/or of the companies who may have supplied such Materials to Trinity Mirror plc. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreements on copyright, moral rights, and other intellectual property rights. All promotional and explanatory material, whether published in the Newspapers or on the Websites, form part of the Terms and Conditions.
- Entrants may not modify, reproduce, distribute, exchange, sell or transmit any of the Material, nor store it in any form (whether tangible or electronic). Copying or downloading materials for any business, commercial or public purpose is strictly forbidden. Civil or criminal liability may result from any use in contravention of this clause. The Game's name and logo, and any other graphics, logos and trademarks used in the Newspapers or on the Websites are protected by laws and international agreements on intellectual property. None of the trademarks may be used in association with the products or services of a third party or in a manner which could, either directly or indirectly, defame or discredit us or a third party. All trademarks and trade names appearing on the Website (including names or products belonging to third parties) remain entirely the intellectual property of the Promoter or Trinity Mirror plc or the intellectual property of their respective owners (as the case may be).
- The Promoter and Trinity Mirror plc reserve the right, at both parties sole and absolute discretion, to rule on any unforeseen circumstances or circumstances beyond our control in whatever way the Promotor and/or Trinity Mirror plc deem most appropriate (including the cancellation or postponement of the Game or changes to these Terms and Conditions) in order to reach what is either party considers to be an equitable solution for the Entrants to the Game. The Promoter and/or Trinity Mirror plc's decision will be announced on the Website as soon as reasonably practicable after such decision has been reached. No correspondence will be entered into by the Promoter or Trinity Mirror plc in respect of such decision which will be final and binding in all respects.
- Neither the Promoter nor Trinity Mirror plc shall be liable for its failure fully to perform their obligations under this Agreement if and to the extent that such failure is due to reasons of force majeure or change in laws or regulations or any other occurrence beyond either parties reasonable control.
- These Terms shall be governed by and interpreted in accordance with English law and Entrants hereby submit to the exclusive jurisdiction of the English courts in connection with any dispute that may arise regarding any aspect of the Game or the Terms.
- SMS Score Alerts: Golf Genius players who are connected to and registered with the Vodafone, T-Mobile, O2, Orange, Hutchison3G UK cellular phone networks and Vodafone, Meteor and O2 ROI cellular networks may subscribe to receive SMS updates on their mobile phones reporting the performance of their team(s) and the overall leader score by completing the SMS registration procedure to the satisfaction of the Promoter. The SMS updates are available on a weekly basis at a maximum cost of 25 pence per message received (including VAT), which will be debited against the entrant's registered mobile phone account. You may unsubscribe from the update service at any time by either updating your personal details on the relevant page of the Websites, by calling the helpline on 0870 487 0183 (calls charged at the national rate) or by sending YTM STOP to 86633 or STOP to 86633 from your mobile phone. The Promoter reserves the right to suspend or cancel the provision of the SMS updates without notice and for any reason.
